Welcome to The PedalCycle. These Terms and Conditions ("Terms") govern your rental and use of our party bike services (the “Service”). By booking or participating in our Service, you agree to abide by these Terms. Please read them carefully before using our Service.

1. Eligibility and Acceptance of Terms

  • You must be at least 21 years old to rent or operate our party bike. Passengers must be at least 21 years old.

  • By renting our Service, you agree to comply with these Terms and any local laws or regulations.

2. Booking and Payment

  • Reservations: All bookings must be made in advance through our website, over the phone, or in person. Payment in full is required to secure your reservation.

  • Payment: Full payment must be completed before the start of your reservation. We accept all major credit and debit cards, including Visa, MasterCard, American Express, and Discover, as well as cash payments.

  • Cancellations: Cancellations made by the customer are non-refundable. However, if we must cancel your reservation, you will receive a full refund.

  • Minimum Booking Requirement: Our party bike requires a minimum booking of six seats to operate. If fewer than six seats are booked for your time slot, we will notify you. Should we need to cancel the ride due to this minimum requirement, we will work to reschedule your reservation or, if rescheduling is not possible, issue a full refund. 

3. Alcohol Policy

  • BYOB (Bring Your Own Beverage): If permitted, you may bring your own alcoholic beverages. All alcohol must be in compliance with local laws, and no open containers are allowed before boarding.

  • Consumption Rules: Only passengers aged 21 and older may consume alcohol. Excessive drinking, intoxication, or unruly behavior will result in immediate removal from the bike and possible termination of the rental without a refund.

  • Alcohol Restrictions: Please review local laws regarding alcohol on open-air vehicles, as some jurisdictions have specific rules.

4. Passenger Conduct

  • You and your guests are expected to conduct yourselves respectfully and responsibly. No disruptive or dangerous behavior, including standing or hanging off the bike, will be tolerated.

  • The driver has full authority to remove any passenger whose behavior is deemed dangerous, disruptive, or in violation of these Terms.

5. Waiver of Liability and Assumption of Risk

  • By participating in our Service, you acknowledge the inherent risks associated with riding a party bike, including but not limited to, personal injury, property damage, or accidents.

  • You agree to release, waive, and hold harmless The PedalCycle, its employees, and affiliates from any claims, damages, injuries, or liabilities arising from your use of the Service.

6. Damage and Cleaning Fees

  • Damage: Any damage to the party bike or equipment resulting from negligence, misuse, or unruly behavior by you or your guests will be your financial responsibility. Repair costs will be assessed and charged accordingly.

  • Cleaning Fee: A cleaning fee may apply if the party bike is left in an unusually dirty or unsanitary condition. Fees will be charged to the card on file or billed to the individual who made the reservation.

7. Weather Policy

  • Cancellations Due to Weather: In case of severe weather that makes it unsafe to operate, The PedalCycle reserves the right to cancel or reschedule your booking. You may be eligible for a refund or an alternative date if your booking is canceled due to weather.

8. Photo and Video Consent

  • By participating in our Service, you consent to being photographed or recorded, and grant us permission to use any photos or videos taken for promotional purposes. If you do not wish to be photographed, please inform us in advance.

9. Indemnification

  • You agree to indemnify and hold The PedalCycle harmless from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your or your guests’ use of the Service or violation of these Terms.

10. Termination of Service

  • We reserve the right to terminate the Service at any time if you or your guests violate these Terms, act in a way that endangers others, or engage in illegal activities. No refunds will be issued in these circumstances.

11. Governing Law

  • These Terms are governed by and construed in accordance with the laws of New Jersey. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts in New Jersey, United States of America.

12. Changes to Terms and Conditions

  • We may update these Terms periodically. Any changes will be posted on this page with an updated date. Your continued use of our Service after changes are made constitutes acceptance of the revised Terms.
